Dear Litigants:
This
letter pertains to a grievance filed by JoAnne Newman against John Lewellen for
violating her right to compete as well as various sections of the USA Boxing
Code of Conduct.
On
March 7, 2012 the USA Boxing Judicial Committee heard this grievance by
telephone conference call. Both litigants were present and did testify. Christian
Daniel, Teresa Mott, Margaret Lewellen, Bobby Packer, Krista Sims, Nikki
Messer, and Tommy Dangerfield testified on Mr. Lewellen’s behalf. Robert Owen was present but did not testify.
The Judicial Committee, after reading the documents previously presented and listening to the oral testimony, believes the allegations were proven as follows.
Article XIV, Section 214.2 Right to Compete/Participate threatened or denied. Mr. Lewellen violated this rule.
USA Boxing Code of Conduct (1); Will act in a manner consistent with the spirit of fair play and responsible conduct. Mr. Lewellen violated this part of the code.
USA Boxing Code of Conduct (11); Will abide by the policies and rules established by USA Boxing, the USOC and the Association International De Boxe Amateur (AIBA). Mr. Lewellen violated this part of the code.
USA Boxing Code of Conduct (12); Will respect others, including my teammates, coaches, competitors, officials and spectators. Mr. Lewellen violated this part of the code.
USA Boxing Code of Conduct (13); Will not engage in, nor tolerate, any form of verbal, physical or sexual abuse. Mr. Lewellen violated this part of the code.
Mr. Lewellen, President of the South Carolina LBC, is instructed to place this letter, in its totality, on the LBC web site for a period of not less than 60 days, beginning May 1, 2012. If this posting is accomplished no further action will be taken. If this directive is not followed, Mr. Lewellen will be charged with failure to cooperate with the Judicial Committee.
If any of the litigants wishes to appeal this decision please contact Lynette Smith at USA Boxing (1-719-866-2311) for further information.
